The Peace Accords Matrix (PAM) at the University of Notre Dame’s Kroc Institute for International Peace Studies has released a new special report outlining the current implementation status of the ethnic approach within the 2016 Colombian Peace Agreement. The ethnic chapter within the Agreement is highly innovative and addresses the systemic and disproportionate victimization that ethnic communities suffered during the country’s armed conflict. It includes commitments meant to safeguard human rights and protections for these communities.
The special second report, “Challenges and Opportunities to Incorporate the Ethnic Focus in Territorial Implementation,” covers implementation of the ethnic approach from November 2020 through November 2021. During this period, the Institute found that the gap between overall implementation of the Peace Agreement and implementation of the ethnic approach persisted. This was particularly apparent among completed commitments.
The Kroc Institute has identified 80 stipulations in the Peace Agreement that are used for monitoring the ethnic approach, including 13 stipulations from the Ethnic Chapter under Point 6. This report analyzed more than 300 implementation events and consulted secondary sources at both the territorial and national levels. During the study period, no stipulations relating to the ethnic focus were completed, although there were slight changes in stipulations at the non-initiated, minimum and intermediate levels.
The report also notes a decrease in non-initiated ethnic stipulations, moving from 21% in 2020 to 15% in 2021. This constitutes the greatest change recorded during the period of the report. Ethnic stipulations at a minimum level of implementation changed from 58% to 60%, and those in an intermediate stage moved from 9% in 2020 to 13% in 2021. Completed stipulations under the ethnic approach stand at 13%. Because no provisions were completed during this period, the gap between implementation of the ethnic approach and overall implementation of the Accord has increased 1%.
The special report also includes qualitative analysis exploring four thematic areas within the ethnic approach: effective participation of communities and free, prior and informed consultation; territorial transformation in ethnic communities; reincorporation and security guarantees; and ethnic community victims in the Comprehensive System for Peace (SIP).
Despite challenges in completing stipulations with an ethnic focus, the Kroc Institute believes progress can continue to be made, and the report highlights key opportunities to strengthen implementation of the ethnic approach. Opportunities include the increase and improvement of effective participation alongside the right to free, prior and informed consultation. This can be achieved through the work of the Office of the Presidential Councilor for Stabilization and Consolidation (CPEC) and its promotion of dialogue between the Special High-Level Forum with Ethnic Peoples (IEANPE) and the Commission for Monitoring, Promoting and Verifying the Implementation of the Final Agreement (CSIVI).
Other opportunities highlighted include work by the Reincorporation and Normalization Agency (ARN) to conclude consultation processes with ethnic communities to advance processes for reincorporation of ex-combatants with an ethnic approach, and focused efforts by the Special Jurisdiction for Peace (JEP) to issue judicial decisions on macro territorial cases where most victims belong to ethnic communities. Continued attention on international agencies actively accompanying and promoting implementation of the ethnic approach will also be important.
The Kroc Institute will release its sixth comprehensive report on overall Peace Agreement implementation in Colombia in June.

El Instituto Kroc publica un informe especial sobre el estado de implementación del enfoque étnico del Acuerdo de Paz de Colombia
La Matriz de Acuerdos de Paz (PAM, por sus siglas en inglés) del Instituto Kroc de Estudios Internacionales de Paz de la Universidad de Notre Dame, publicó un nuevo informe especial sobre el estado de la implementación del enfoque étnico del Acuerdo de Paz de Colombia de 2016. El Capítulo Étnico del Acuerdo es altamente innovador y aborda la victimización sistémica y desproporcionada que sufrieron las comunidades étnicas durante el conflicto armado en el país. Para la implementación de este enfoque, el Acuerdo de Paz incluye compromisos que buscan garantizar los derechos humanos y la protección de estas comunidades.
El segundo informe especial, "Desafíos y oportunidades para incorporar el enfoque étnico en la implementación territorial", presenta el estado de la implementación del enfoque étnico entre noviembre de 2020 y noviembre de 2021. Durante el período cubierto por el informe, el Instituto Kroc encontró que persistió la brecha entre la implementación general del Acuerdo de Paz y la implementación del enfoque étnico. Esta brecha fue particularmente evidente entre las disposiciones que han completado su implementación.
El Instituto Kroc identificó y seleccionó 80 disposiciones del Acuerdo Final para hacer seguimiento al enfoque étnico, las cuales incluyen 13 disposiciones del Capítulo Étnico del Punto 6. Este informe analizó más de 300 eventos de implementación y consultó fuentes secundarias tanto a nivel territorial como nacional. Como resultado de esta investigación, se halló que durante el periodo de estudio, no se completó ninguna disposición con enfoque étnico, aunque hubo ligeros cambios en las disposiciones en niveles de implementación no iniciado, mínimo e intermedio.
El informe también señala una disminución de las disposiciones étnicas no iniciadas, pasando de 21% en 2020 a 15% en 2021. Este constituye el mayor cambio registrado durante el periodo de estudio del informe. Las disposiciones étnicas en un nivel mínimo de implementación pasaron de 58% a 60%, y las que se encuentran en una fase intermedia aumentaron de 9% en 2020 a 13% en 2021. Las disposiciones completas del enfoque étnico continuaron en un 13%. Debido a que no se ha completado ninguna disposición durante este periodo, la brecha entre la implementación del enfoque étnico y la implementación general del Acuerdo aumentó en un 1%.
El informe especial también incluye un análisis cualitativo que comprende cuatro ejes temáticos del enfoque étnico: la participación efectiva y la consulta previa, libre e informada de las comunidades étnicas; la transformación territorial en los territorios étnicos; el proceso de reincorporación y las garantías de seguridad; y las víctimas pertenecientes a comunidades étnicas en el Sistema Integral para la Paz (SIP).
A pesar de los retos para completar las disposiciones con enfoque étnico, el Instituto Kroc considera que se puede seguir avanzando en estos compromisos y el informe destaca oportunidades que son clave para fortalecer la implementación del enfoque étnico. Las oportunidades incluyen el aumento y la mejora de la participación efectiva junto con la garantía del derecho a la consulta previa, libre e informada. Estas acciones pueden lograrse mediante la labor de la Consejería Presidencial para la Estabilización y la Consolidación (CPEC) y su promoción del diálogo entre la Instancia Especial de Alto Nivel con los Pueblos Étnicos (IEANPE) y la Comisión de Seguimiento, Impulso y Verificación de la Implementación del Acuerdo Final (CSIVI).
Otras oportunidades destacadas son la conclusión de procesos de concertación con las comunidades étnicas por parte de la Agencia para la Reincorporación y la Normalización (ARN) para avanzar en los procesos de reincorporación de excombatientes con enfoque étnico, y la concentración de esfuerzos por parte de la Jurisdicción Especial para la Paz (JEP) para proferir decisiones judiciales en los macro casos territoriales donde la victimización es preponderantemente étnica. También es importante que los organismos internacionales sigan acompañando y promoviendo activamente la implementación del enfoque étnico.
El Instituto Kroc publicará su sexto informe comprensivo sobre la implementación general del Acuerdo de Paz en Colombia en junio de 2022.
